AGREEMENT* ON INTERNATIONAL COOPERATION ON ISSUES RELATED TO THE CONSEQUENCES OF THE ACCIDENT AT THE CHERNOBYL NPP AGREEMENT THE GOVERNMENT OF THE RUSSIAN FEDERATION June 23, 1992 (NCPI) ________________ * Between the Commission of the European Communities and the Government of the Republic of Belarus, the Government Russian Federation, Government of Ukraine. The European Atomic Energy Community (hereinafter referred to as the "Community"), represented by the Commission of the European Communities (hereinafter referred to as the "Commission"), represented for the purpose of signing this Agreement by its Vice-President Mr. Filippo Maria Pandolfio on the one hand, and the State Committee of the Republic of Belarus on problems catastrophe at the Chernobyl nuclear power plant, represented by the Chairman of the Committee I.A. of the population from the consequences of the accident at the Chernobyl nuclear power plant, represented by the Minister G.A. Gotovchits (referred to below as "Ministries"), responsible for scientific programs carried out by research institutes located in the territories of the respective states and listed in Annex I, with others on the other hand, given that the Community and the Ministries are interested in international cooperation on issues of radioecology and organization of measures to overcome the consequences of nuclear emergencies; Taking into account the Agreement on Conducting International Research into the Consequences of the Chernobyl Accident concluded on 21 September 1990 between the Union of Soviet Socialist Republics, the Byelorussian Soviet Socialist Republic and the Ukrainian Soviet Socialist Republic and their scientific organizations and the International Atomic Energy Agency; political and economic changes that have taken place in the former USSR; the preliminary work carried out by the Community, directly or through the authorities of the Member States of the Community and the countries associated with the Community Radiation Protection Programme, former USSR, the Byelorussian SSR and the Ukrainian SSR or through state bodies concerning the preparation of joint scientific projects related to the consequences of the Chernobyl accident and their mitigation; have agreed as follows: Article 1 General provisions 1. The Community, through its Joint Research Center and scientific organizations and through the authorities of the Member States of the Community and the countries associated with the Community Radiation Protection Programme, in cooperation with the Ministries, shall carry out the projects defined in annex II, which forms an integral part of this Agreement. 2. In this Appendix, projects to be implemented are identified only by their names. A detailed description of the projects, including financial aspects, will be prepared according to the needs of the Parties. The Annex may be amended by written notice after discussion by the Coordinating Council referred to in Article 2. 3. The Community and Ministries shall ensure that participating organizations will act in accordance with the terms of this Agreement. 4. The Parties shall provide project participants and their personnel involved in the implementation of projects with appropriate conditions for the exercise of their functions, including visa and customs facilities. Article 2 Coordinating Council To ensure effective management of joint projects, a Coordinating Council is established, consisting of representatives of all parties. The composition, powers and rules of procedure of this Council are set out in Annex III to this Agreement, which forms an integral part of it. Article 3 Peaceful Uses of the Results The Parties represent and warrant that the results of activities carried out by them or participating Organizations under this Agreement will be used exclusively for peaceful purposes. Article 4 Intellectual Property 1. Unless otherwise agreed by the Parties, copyrights, patents and all other rights in relation to any results obtained in the course of the implementation of projects shall belong to the participants in the projects in accordance with their contribution. 2. The parties warrant that the information provided for publication does not violate copyright laws. Article 5 Confidentiality of Information 1. The Parties and their representatives will maintain the confidentiality of any unpublished information that becomes known to them through participation in the projects. 2. The decision to change the degree of confidentiality is taken by the Coordinating Council. Article 6 Use and Ownership of Equipment, Appliances and Materials Until the Parties agree otherwise: a) any equipment and materials brought into the territory of the States Parties to the Agreement by the Community or participating bodies in connection with projects shall be used only for the purposes of the projects; b) the ownership of the equipment, instruments and materials referred to above will be retained by the Community or by the relevant authority; c) upon completion of the implementation of the projects, the equipment, instruments and materials referred to in the previous paragraphs of this Article shall be removed from the territory of the States Parties to the Agreement by the Community or the relevant authority as necessary. The Belarusian, Russian and Ukrainian Parties shall not bear any costs associated with such return or transfer; d) The Parties shall do everything necessary measures that both importation and exportation of any equipment, instruments and materials related to the projects be free from any fees and duties in their territory. Article 7 Responsibilities and Obligations a) Each Party shall be responsible for health insurance or any other social security arrangements for its personnel assigned to work on projects in accordance with its laws; b) In connection with the implementation of projects, the Parties participating in the projects: i) release each other from liability for any damage or injury caused as a result of acts or omissions committed by their own personnel in connection with the implementation of projects; ii) be liable for any damage or injury resulting from acts or omissions committed by their own personnel in connection with the implementation of the projects; iii) be jointly responsible for any damage or injury caused by joint actions or omissions committed by their personnel in connection with the implementation of the projects. Article 8 Dispute Resolution Any dispute arising out of the interpretation or application of this Agreement which cannot be settled through consultations between the Parties involved or by any other means agreed between them may be submitted to arbitration by either of the parties to the dispute. formed as follows: each party to the dispute shall appoint one arbitrator, and the two arbitrators thus appointed shall elect a third who shall be the chairman. A majority of the members of the arbitral tribunal constitutes a quorum, and all decisions require the consent of two arbitrators. The arbitration procedure is established by the arbitration court. The decisions of the arbitral tribunal are binding on the parties to the dispute. Article 9 Amendments This Agreement may be amended by mutual agreement of its Member Parties by exchange of written notifications to that effect. Article 10 Entry into force This Agreement shall enter into force upon its signing by the Participating Parties and shall remain in force until completion of the agreed projects. Article 11 Termination of the Agreement This Agreement may be terminated by either Party by giving six months' written notice of its intention. Joint research projects- Development of computer systems ( software) for the purpose of predicting the radiological consequences of accidents for decision-making in case of emergencies, including modeling of probable dose loads. - Development and testing of methods for determining the level of intervention and implementation of countermeasures in the event of a nuclear accident (including cost-benefit, risk-benefit, multivariate or other analyses). Appendix III Coordinating Council Article 1 Composition 1.1. The Coordinating Council is established for the purpose of implementing this Agreement, consisting of three representatives of the Commission and one representative and one observer from each Ministry. 1.2. Each of the contracting Parties communicates to the other Parties the names of its representatives and observers. In necessary cases, substitutions of any of the representatives are allowed. Article 2 Functions and powers The Coordinating Council exercises control over the implementation of the Agreement and, in particular: - selects scientific projects, the implementation of which is of common interest to the Parties participating in this Agreement and approves detailed description work programs, composition of participants and a preliminary estimate of costs; - approves project managers responsible for their implementation and coordination; - prepares and submits to the Parties annual reports on the implementation of this Agreement; - supervises the implementation of selected scientific projects and, in particular, approves the technical reports submitted by the project managers; - decides on a case-by-case basis on the decontamination of equipment, instruments and materials associated with the projects and on the distribution of the corresponding costs between the Parties. Article 3 Basic Procedural Rules 3.1. The Coordinating Council appoints a Chairperson and Vice - one representative of the CES and one from the Ministries, who remain in these posts for a period determined by the Coordinating Council. 3.2. The Chairman calls meetings and directs the work of the Coordinating Council. The Coordinating Council is convened by the Chairman at least twice a year. Special meetings of the Coordinating Council are convened by decision of the Chairman or at the request of at least half of the members of the Council. 3.3. Detailed procedural rules for the work of the Coordinating Council are established by the Coordinating Council itself. Amendments to the above rules can only be made with the written consent of the Parties.

The participating states will strive to meet the mutual needs in the education of citizens, training, retraining and advanced training of workers and specialists, defining on a bilateral basis a mechanism for mutual financial settlements when reimbursing the costs incurred by each participating state for the education of pupils, students, graduate students and listeners, who are not its citizens and do not have a permanent place of residence in its territory. The participating states undertake to continue education (until it is completed) for citizens of the participating states who do not have a permanent place of residence in the territory of the participating state where they study, and who enrolled for training before January 1, 1992 on the conditions applicable to citizens of this state - participant. 12

12 Article 2 The participating States guarantee the equality of all educational institutions included in their national education systems, regardless of the language of instruction, and provide them with state support. Article 3 The participating States shall contribute to meeting the educational needs of the population belonging to national minorities and distinctive ethnic groups, including by creating conditions for receiving education in their native language, providing mutual assistance in providing and developing original textbooks and other educational and methodological literature, in training and retraining of teaching staff for national minorities and ethnic groups. Article 4 Bodies of state attestation of scientific and pedagogical personnel of the participating states may conduct attestation of citizens of other states. Article 5 The participating states guarantee the indefinite recognition in their territories of state documents on secondary, vocational, secondary specialized, higher education, retraining of personnel, on the award of academic degrees and academic titles issued in the participating states by the time of the conclusion of this Agreement. The issues of recognition of documents on education, on academic degrees and academic titles in the future, the participating states will decide by mutual agreement. Article 6 The participating states shall provide conditions for the training of pedagogical and scientific-pedagogical personnel for educational institutions where teaching is conducted in non-state languages. The European Atomic Energy Community (hereinafter referred to as the "Community"), represented by the Commission of the European Communities (hereinafter referred to as the "Commission"), represented for the purpose of signing this Agreement by its Vice-President, Mr Filippo Maria Pandolfio on the one hand, and

The State Committee of the Republic of Belarus on the problems of the catastrophe at the Chernobyl nuclear power plant, represented by the Chairman of the Committee I.A.Kenik,

considering that the Community and the Ministries are interested in international cooperation on radioecological issues and organization of measures to overcome the consequences of nuclear emergencies;

preliminary work carried out by the Community, directly or through the authorities of the Member States of the Community and the countries associated with the Community Radiation Protection Programme, the former USSR, the Byelorussian SSR and the Ukrainian SSR, or through public authorities, concerning the preparation of joint scientific projects related to the consequences of the Chernobyl accident and their mitigation;

agreed on the following:

General provisions

1. The Community, through its Joint Research Center and scientific organizations and through the authorities of the Member States of the Community and the countries associated with the Community Radiation Protection Programme, in cooperation with the Ministries, shall carry out the projects defined in annex II, which forms an integral part of this Agreement.

2. In this Appendix, projects to be implemented are identified only by their names.

A detailed description of the projects, including financial aspects, will be prepared according to the needs of the Parties. The Annex may be amended by written notification after discussion by the Coordinating Council referred to in Article 2.

3. The Community and the Ministries guarantee that participating organizations will act in accordance with the terms of this Agreement.

4. The Parties shall provide project participants and their personnel involved in the implementation of projects with appropriate conditions for the exercise of their functions, including visa and customs facilities.

Coordinating Council

To ensure effective management of joint projects, a Coordinating Council is created, consisting of representatives of all parties. The composition, powers and rules of procedure of this Council are set out in Annex III to this Agreement, which forms an integral part of it.

Peaceful use of results

The Parties represent and warrant that the results of activities carried out by them or participating Organizations under this Agreement will be used exclusively for peaceful purposes.

Intellectual property

1. Unless the Parties agree otherwise, copyrights, patents and all other rights in relation to any results obtained in the course of the projects will belong to the project participants in accordance with their contribution.

2. The parties warrant that the information provided for publication does not violate copyright laws.

Information privacy

1. The Parties and their representatives will keep confidential any unpublished information that becomes known to them through participation in the projects.

2. The decision to change the degree of confidentiality is taken by the Coordinating Council.

Use and ownership of equipment, instruments and materials

Until the Parties agree otherwise:

a) any equipment and materials imported into the territory of the States Parties to the Agreement by the Community or participating bodies in connection with projects shall be used only for the purposes of implementing the projects;

b) the ownership of the equipment, instruments and materials referred to above will be retained by the Community or by the relevant authority;

c) upon completion of the implementation of the projects, the equipment, instruments and materials referred to in the previous paragraphs of this Article shall be removed from the territory of the States Parties to the Agreement by the Community or the relevant authority as necessary. The Belarusian, Russian and Ukrainian Parties shall not bear any costs associated with such return or transfer;

d) The Parties shall take all necessary measures to ensure that both the import and export of any equipment, instruments and materials related to the Projects are free from any fees and duties in their territories.

Responsibility and obligations

a) Each Party shall be responsible for health insurance or any other social security arrangements for its personnel assigned to work on projects in accordance with its legislation;

b) In connection with the implementation of projects, the Parties participating in the projects:

(i) release each other from liability for any damage or injury resulting from acts or omissions committed by their own personnel in connection with the implementation of the projects;

ii) be liable for any damage or injury resulting from acts or omissions committed by their own personnel in connection with the implementation of the projects;

iii) be jointly responsible for any damage or injury caused by joint actions or omissions committed by their personnel in connection with the implementation of the projects.

Resolution of controversial issues

Any dispute arising out of the interpretation or application of this Agreement which cannot be settled by consultation between the Parties involved or by any other means agreed between them may be submitted by either of the parties to the dispute to arbitration constituted as follows: each party to the dispute shall appoint one arbitrator, and the two arbitrators so appointed shall elect the third one, who shall be the chairman. A majority of the members of the arbitral tribunal constitutes a quorum, and all decisions require the consent of two arbitrators.

The arbitration procedure is established by the arbitration court.

The decisions of the arbitral tribunal are binding on the parties to the dispute.

Amendments

This Agreement may be amended on the basis of the mutual consent of its Member Parties through the exchange of written notifications to this effect.

Entry into force

This Agreement shall enter into force upon its signing by the Participating Parties and shall remain in force until the completion of the agreed projects.

Termination of the Agreement

This Agreement may be terminated by one of the Parties by submitting six months' written notice of its intention.

During the first year of the Agreement, the following projects will be implemented:

Joint Pilot Projects

Theoretical and experimental assessment of the magnitude and nature of secondary contamination of environmental objects with radioactive substances (including hot particles).

- Entry of radionuclides through terrestrial ecosystems into agricultural products and farm animals.

- Modeling and studying the mechanisms of the transfer of radioactive substances from terrestrial ecosystems to aquatic environments and their behavior in aquatic ecosystems.

- Development and improvement of a decontamination strategy for various environmental situations, including the territory settlements, agricultural land, forests, etc.

- The behavior of radionuclides in natural and semi-natural ecosystems (forests, swamps, etc.).

Joint research projects

Development of computer systems (software) for the purpose of predicting the radiological consequences of accidents for decision-making in case of emergencies, including modeling of probable dose loads.

- Development and testing of methods for determining the level of intervention and implementation of countermeasures in the event of a nuclear accident (including cost-benefit, risk-benefit, multivariate or other analyses).

Coordinating Council

1.1. The Coordinating Council is established for the purpose of implementing this Agreement, consisting of three representatives of the Commission and one representative and one observer from each Ministry.

1.2. Each of the contracting Parties communicates to the other Parties the names of its representatives and observers. In necessary cases, substitutions of any of the representatives are allowed.

Functions and powers

The Coordinating Council exercises control over the implementation of the Agreement and, in particular:

- selects scientific projects, the implementation of which is of common interest to the Parties participating in this Agreement and approves a detailed description of the work programs, the composition of participants and a preliminary estimate of costs;

- approves project managers responsible for their implementation and coordination;

- prepares and submits to the Parties annual reports on the implementation of this Agreement;

- supervises the implementation of selected scientific projects and, in particular, approves the technical reports submitted by the project managers;

- decides on a case-by-case basis on the decontamination of equipment, instruments and materials associated with the projects and on the distribution of the corresponding costs between the Parties.

Basic Procedural Rules

3.1. The Coordinating Council appoints a Chairperson and Vice - one representative of the CES and one from the Ministries, who remain in these posts for a period determined by the Coordinating Council.

3.2. The Chairman calls meetings and directs the work of the Coordinating Council. The Coordinating Council is convened by the Chairman at least twice a year. Special meetings of the Coordinating Council are convened by decision of the Chairman or at the request of at least half of the members of the Council.

3.3. Detailed procedural rules for the work of the Coordinating Council are established by the Coordinating Council itself. Amendments to the above rules can only be made with the written consent of the Parties.

  1. Subject of the Agreement

Based on the voluntary desire for joint educational and research activities, as well as on the basis of the mutual desire to promote the development friendly relations between States, the Parties agree as follows:


  • exchange information on achievements in the field of organization of the educational process, research and teaching and methodological developments;

  • to promote the creation of the necessary conditions for the provision of internships and exchange of teachers in order to improve the quality of the educational process;

  • take measures to develop mutual exchange of students within the framework of the educational process;

  • plan and develop joint educational and research projects and programs;

  • ensure the holding of joint educational, scientific and scientific-practical and cultural events: conferences, seminars, symposiums, summer schools, etc.;

  • publish the results of joint research and exchange publications, educational and methodological literature, reference and statistical materials of mutual interest.

  1. Rights and obligations of the parties

2.1. Each of the Parties undertakes to find sources of funding necessary for its participation in the activities under the Treaty. Conducting joint activities will depend on the possibility of their financing by the Parties. The costs associated with organizing the settlement of teachers within the framework of the exchange, the Parties will bear on the principle of reciprocity.

2.2. Any changes and additions to the Agreement must be executed by the Parties in the form of additional agreements and will be an integral part of this Agreement.

2.3. All activities under the Agreement are carried out by the Parties in accordance with their regulatory documents, as well as relevant state and local legislation.

2.4. Each of the Parties appoints a contact person for communications related to the implementation of the provisions of the Agreement.

2.5. The Parties undertake, in the event of disputes regarding the implementation of the Agreement, to take all measures to resolve them without resorting to third parties.


  1. Contract time

3.1. The Agreement is concluded in duplicate, having equal legal force, for a period of 5 years and can be automatically extended until the Parties express a desire not to renew it.

3.2. Each of the Parties may terminate the Agreement or refuse to renew it by notifying the other Party in writing 90 days before the proposed termination, provided that this does not affect the implementation of the current agreed activities.

I express my sincere gratitude to everyone and everyone who took part in the creation of the Russian Professorial Assembly, supported the young organization in word and deed, and offered solutions. The Russian Professorial Assembly is an organization of federal significance, capable of uniting scientists and teachers, regardless of direction.

The Russian professorial meeting was created to protect the rights of scientific and pedagogical workers, to defend the interests of organizations engaged in scientific and scientific-pedagogical activities.

The Russian professorial meeting sets itself the following goals:

We strive to restore the prestige of scientific and pedagogical work, the high social status of scientific and pedagogical workers. Engaging in scientific and pedagogical activities should become no less prestigious than public service or business.

We strive to ensure that all citizens of the Russian Federation have equal access to quality education that takes into account the modern spiritual and economic needs of both society as a whole and the individual.

We strive to ensure that Russian universities take one of the leading places in the world ranking of universities, so that Russian universities are represented in the top ten universities in the world.

We strive to ensure that a diploma from a Russian university is a real indicator of the availability of quality education and is recognized abroad, so that academic degrees awarded in Russian scientific and educational organizations are recognized all over the world.

We are open for cooperation and want to unite public organizations of scientific and pedagogical workers from all regions of our vast Russia and achieve our goals with common efforts.

Today, the scientific community, represented by the Russian Professorial Assembly, has received an organization that brings together the scientific and pedagogical elite, people who are well aware of the needs Russian science and education, able to determine the vector of its development, identify the most significant problems in these areas and offer the best ways to solve them, boldly express their opinion, defend the interests of the scientific and pedagogical community, conduct a constructive dialogue with all sane forces interested in the successful development of our Fatherland, stability, well-being and prosperity of Russia, to ensure effective communication between civil society and the state.

Russia can be strong only when its science and education are strong. Only with their help it is possible to overcome the global challenges that exist today and will arise in the future. Education forms a person as a person, as a citizen who is selflessly loyal to his Fatherland, equips him with the knowledge and skills necessary for life, and science creates the foundation on which the education system, economy, defense of the country, and society as a whole stand. But in order for our science and education to be successful and competitive, it is necessary that those who create them and continue the glorious traditions laid down by their predecessors have a high social status and be respected.

I am sure that the Russian Professorial Assembly will become a platform for dialogue between various scientific communities, public associations, other institutions of civil society, authorities, and an organization capable of proposing ways to solve the problems facing domestic science and education.
