The intensity of traffic on the roads is growing every year. In this regard, the role of organizations responsible for order in them will also increase. The structure that controls and regulates the markets for transport services began to operate in Russia in 1990. In autumn 2010, the 20th anniversary of the formation of state transport control bodies in the system of the Ministry of Transport is celebrated Russian Federation. Control over compliance by firms and entrepreneurs with legislative acts relating to the transportation of passengers, goods and motor vehicles in Bashkortostan is carried out by the Department of State Road Supervision in the Republic of Bashkortostan of the Federal Service for Supervision in the Sphere of Transport. We learned more about the main activities of the Office from a conversation with its head, Chief State Inspector Sergei Merezhko.

Sergey Nikolaevich, 20 years of activity is quite a long period. But, let's be honest, the organization you lead is not well known. What are its main functions?

Perhaps, for someone the existence of our organization will really be a revelation. But I note that the Directorate is the legal successor of the Bashkir Republican Branch of the Russian Transport Inspectorate, and this name is well known to many. So I would not classify our organization as a little-known one. Another thing is that some people do not know about us, although they encounter those whom we control on a daily basis. Our competence includes state control over the observance of order in the road complex. Under our control are such transport organizations as State Unitary Enterprise "Bashavtotrans", LLC " Pan Auto", Company " Ufa-line”and others, as well as entrepreneurs engaged in the transportation of passengers and goods.

The Department licenses activities for the transportation of passengers by road, and also issues certificates of admission to international road transport and special permits for the transport of dangerous goods in international traffic. Thus, conditions are created for the normal functioning of the transport services market related to the transportation of passengers and goods. In addition to monitoring compliance with licensing requirements, regulations governing the activities of road transport and the road sector, our service supervises compliance with the legislation of the Russian Federation, including international treaties Russia on the procedure for the implementation of international road transport, weight control of vehicles engaged in freight transportation. It also checks compliance with the requirements of regulatory documents in the design, construction, reconstruction, repair and maintenance of public roads.

In a word, all the daily activities of the Department are aimed at observing socially significant interests in the field of security traffic, preservation of life and health of citizens during the transportation of passengers by road and freight traffic. How does your Office influence the organization of transport services in municipalities and improve the quality of transport services provided?

This, of course, is given due attention. In accordance with federal legislation, the responsibility for organizing transport services in municipalities is assigned to local governments. And we, in turn, control how they exercise these powers. Thus, since the beginning of the year, local self-government bodies of 10 municipalities of the republic have been inspected on the organization of transport services and the creation of conditions for the provision of transport services to the population.

With regard to the quality of the services provided, when carrying out our control measures, the Department, first of all, pays attention to the safety of transportation. To this end, a specially created commission of the Department regularly conducts certification of executive heads and specialists of motor transport enterprises - mechanics, dispatchers and other specialists responsible for the safety of vehicles for the right to occupy their positions. It also checks the level of qualification training of specialists related to the organization of transportation of passengers and goods by road in the Russian Federation. When carrying out this work, the main attention is paid to the availability, knowledge and performance by executive managers and specialists of official duties to ensure the safe operation of vehicles.

For 7 months of 2010, more than 500 executive managers and specialists related to road safety were certified. About 200 people did not pass certification. In connection with the negative results of certification, 90 specialists were suspended from their duties. And for improper performance of official duties to ensure road safety, 4 vehicle specialists were sent for early recertification.

— How often are you contacted for licenses? What is the meaning of the license for passengers?

If we talk only about the last period, then for seven months of 2010 we issued one special permit for the international transportation of dangerous goods by road, 43 licenses for the carriage of passengers by road (for the same period in 2009, 45 licenses were issued). Almost 4,000 license cards have been issued for motor vehicles carrying passengers, which is 40 percent more than in 7 months of 2009.

Over the past period of 2010, the Department's specialists carried out over 500 inspections of economic entities operating in the field of road transport in the Republic of Bashkortostan. Including 218 inspections of license holders and 269 inspections of road transport entities whose activities are not subject to licensing.

Having a license is a prerequisite for legal business activity. But it is possible to ensure the safety of transportation only through the implementation of high-quality control measures, both planned and unscheduled. When issuing a license, we check all the documentation submitted by the entrepreneur. The license entitles the owner of a motor transport company or entrepreneur to engage in this type of activity, at the same time it imposes on them the obligation to control safety. They are responsible for the serviceability of the car and the condition of the driver and, accordingly, must control the pre-trip medical examination, technical inspection. The department has the right to carry out a scheduled inspection only once every three years. Unscheduled - in accordance with Federal Law No. 294 on the basis of the expiration of the deadline for the execution of a previously issued order or upon receipt by the department of information about a threat to life, health of citizens. In addition, departure to the carrier's line must be agreed with the administration of the municipality. The established route is developed taking into account the passenger traffic. If an entrepreneur goes on someone else's route, then he violates the traffic schedule, which increases the risk of traffic accidents and injuries.

It should be noted that the carrier company, in which case, is responsible for the damage caused together with the driver. I note that the punishment for negligently causing major damage or causing grievous bodily harm has recently been tightened to seven years in prison. Let me give you one of the recent cases as an example. In Sterlitamak, a bus driver of a licensed transport company knocked down an orphanage boy. Okay, not dead. But the child had to be treated for a long time. The investigation has not yet been completed, but we hope that the entrepreneur who put this particular guy behind the wheel, and, of course, the driver himself, will be held accountable for the incident to the fullest extent of the law. I want to emphasize that most often misunderstandings and accidents occur precisely with those carriers that neglect the requirements of the law in pursuit of a long ruble.

— It is in your competence to control the weight of vehicles, but why is this necessary?

The weight of the vehicle is a very serious criterion, especially in cases where some loaded tractor is driving along the road, crushing the asphalt under it. Moreover, a bridge or other structures on the way can collapse under it. In other words, it causes huge material damage, not to mention the fact that it provokes a traffic accident with all the ensuing consequences. For the passage of heavy vehicles, a special permit is required, according to which the route is determined, escort, and in some cases, the existence of a project that provides for special measures to strengthen engineering structures.

During inspections on federal highways, only since the beginning of 2010, we have identified 312 cases of unauthorized passage of vehicles with excess weight parameters. The damage caused to federal roads exceeds one million rubles. By the way, a great help in maintaining order on the roads can be provided by locals or other caring road users. A person sees, for example, how a heavy vehicle is driving along the road, destroying it, he can report this to the round-the-clock duty officer of the Office by phone and send a written request indicating the state number of the car vehicle violator.

Do your interests overlap with other regulators? How do you interact with them?

Of course, we work closely with other enforcement agencies, law enforcement, public organizations and associations. As for the service directly working on the road (I'm talking about the traffic police), its employees, to some extent, are our colleagues, partners. But our powers are clearly divided by law. The traffic police control the implementation of the requirements for ensuring road safety directly when road users carry passengers and goods by road and monitors the implementation of traffic rules on the street road network and transport infrastructure facilities. Our Department exercises control in the field of road safety through the issuance of established permits for the transportation of passengers and goods by road, as well as by monitoring the fulfillment of license requirements and conditions when carrying out a licensed type of activity in road transport. Special attention when exercising control and supervision activities, the Department pays attention to interaction with other regulatory bodies. For example, we work with the FSB when carrying out antiterrorist measures at transport infrastructure facilities. We also conduct joint inspections with Rospotrebnadzor, the Prosecutor's Office, and local governments.

— How is the perpetrator held accountable?

Since the beginning of 2010 alone, the Department’s specialists have drawn up and sent to the judicial authorities of Bashkortostan 173 protocols on administrative offenses(for the same period in 2009 137 protocols). By a court decision, 112 carriers who committed violations were brought to administrative responsibility with a fine totaling 247,200 rubles. As a result of the control measures taken, 1311 violations of the requirements of transport legislation were identified, which determine the procedure for organizing and carrying out passenger transportation by road, 183 orders were issued to eliminate the identified violations, more than half of which were fulfilled, and 82 orders are at the stage of execution and control. In business entities where accidents occurred on licensed passenger vehicles, the Department conducted 12 inspections to ensure compliance with license requirements and conditions. Based on the results of inspections, 7 protocols on administrative offenses were drawn up, which were sent to the judicial authorities for a decision on bringing to administrative responsibility.

The accident rate for 7 months of 2010 on licensed passenger transport decreased by 8 percent compared to the same period in 2009, there were no deaths, the number of injured decreased by 13 percent.

In order to carry out high-quality control and supervision measures in relation to carriers that allow systematic violations of the norms and rules that ensure the safety of passenger transportation, the Office during 2009-2010. in eight cases, administrative materials were sent to the judicial authorities for a decision on the administrative suspension of activities with the subsequent cancellation of the license. For six of them, a decision was made to requalify part 4 of article 14.1 of the Code of Administrative Offenses of the Russian Federation for part 3 of article 14.1 of the Code of Administrative Offenses of the Russian Federation in the form of a fine. This, in my opinion, is too mild a measure, given the possible tragic consequences. According to one material in 2009, there was a suspension of activities, two materials are being processed by the court. In addition, information about systematic violations was sent to the then acting Ministry of Construction, Architecture and Transport of the Republic of Bashkortostan, the Prosecutor's Office and other regulatory bodies.

The situation on the roads is getting worse. Does the legislation react to this, are the measures tougher for violators of traffic rules?

As I said, due to the increase in traffic intensity, the legislation is changing towards tougher penalties, which, I hope, will force carriers to be more disciplined. Thus, in July of this year, amendments were made to certain legislative acts of the Russian Federation in connection with ensuring transport security. They are enshrined in Federal Law No. 195. In particular, the Criminal Code of the Russian Federation includes an article “Failure to comply with the requirements for ensuring transport security at transport infrastructure and vehicles”. It applies to persons responsible for ensuring such security, if the specified violation caused, through negligence, the infliction of grievous bodily harm or major damage (more than one million rubles), the death of one or more persons. The punishment provided for by the Criminal Code is up to seven years in prison.

Amendments to the Code of Administrative Offenses of the Russian Federation have tightened liability for damage to transport equipment, railway tracks, leaving or dropping objects on them that can disrupt train traffic. Also, now they will be punished for failure to comply with transport security requirements and failure to provide information about acts of unlawful interference at transport infrastructure facilities and vehicles.

Could you give some practical advice how to behave, where to contact citizens in case of disorder.

Unfortunately, legal nihilism and indifference are not easily overcome. But, I must say, there are more and more responsible citizens. They call us with complaints. This alone is not enough for us to respond appropriately. The basis for checking the commission is written statement, which indicates the state number and the specific fact of the threat to the safety of life and health of citizens. If there are witnesses, please provide their details. And, of course, the applicants themselves must sign. For example, passengers of a fixed-route taxi are suspicious of a specific smell and inappropriate behavior of the driver, who, moreover, grossly violates the rules of the road, or the car is clearly out of order, etc. Citizens can, having agreed, write a general statement to our Office indicating the fact of the violation, the coordinates of the taxi and their data. Maybe even with a video application because now many cell phones have built-in photo and video cameras.

Gosavtodornadzor inspectors monitor the state of the road infrastructure on federal highways, and in the event of violations, such as spontaneous gravel ramps, they immediately issue orders to immediately put the highway in order.

- According to the law, municipalities are given a period to eliminate shortcomings, and usually the district authorities meet this period, - says Mr. Merezhko. — Supervision and penalties of our department are taken seriously.

Sergei Merezhko decided to bring order to the passenger transportation market, believing that in this area the control of the State Automobile Inspectorate is necessary in the first place.
“Many have tried before you, but it didn’t work,” we say.
“But it's our job to keep the passengers safe,” he says.

It is interesting that, according to Sergei Nikolaevich, passengers themselves contribute to the fact that in Ufa, and in many cities of Bashkiria, a wild passenger transportation market has developed.

“If our citizens understood the risks of getting into technically imperfect cars of private carriers, there would probably not be so many buses rushing through the streets who want to make money on carts,” says Mr. Merezhko. “And if the residents of the yards where buses of such carriers park at night reported these violations to the mayor's office or complained to us, then there would be less disorder on the roads. Because the overnight stay of a shuttle bus next to the driver's entrance is a clear violation of the rules of road transport, which assume that the provider of motor transport services has a garage, where they not only inspect the technical condition of the car before entering the line, but also check the health of the driver - whether his heart is naughty, not whether he drank too much in the evening.

Unfortunately, according to many experts, most car entrepreneurs prefer not to burden themselves with either excessive infrastructure, let alone technical and medical personnel. It is easier for them to earn money illegally, without paying taxes or mandatory fees from wages. According to some reports, the Bashkir "black" market of road transport "spins" 144 million dollars annually, and the state loses about 147 thousand dollars a year in unpaid taxes. In addition, many license holders do not have vehicles or drivers in the state, and prefer to "sell" routes. According to rumors, the cost of "permission" to travel in one direction or another reaches 200 thousand rubles.

- This is a fraud pure water, - Sergey Nikolaevich is sure. - In order for the bus to serve passengers on the line, it is necessary to participate in the competition for the distribution of routes and obtain permission from the mayor's office. License holders do not consider it necessary to enter into agreements with the administration, but they take upon themselves the legal services of such drivers - they say, if you are involved, contact us.

According to Mr. Merezhko, traffic lawyers will appeal against any action of the traffic inspectorate, hoping to wear down the road guards with lawsuits - they say, next time they will be afraid to issue orders. At the same time, such entrepreneurs do not have special legal knowledge, they simply chose a tactic for themselves: the best defense is an attack.

“But such businessmen cause significant damage to those businessmen who follow the rules of the game: they maintain a staff of drivers, production facilities and Maintenance- explains Sergey Nikolaevich. - A conscientious entrepreneur, fulfilling the conditions of the competition, serves this or that route all day long, even when there are no passengers, and goes to certain expenses. And the unscrupulous ones sleep during the day and leave only during peak hours to collect the cream from the routes on the main streets and deprive an honest businessman of funds. Yes, and the driver thinks: “Why do I need this fuss - with a return to the garage, a medical examination, strict technical control, a fixed number of shifts, getting up at four in the morning? After all, it’s easier to work on your own and there are no problems, the bus at the entrance, when it wanted to, then went to the line, and to the one where you can collect more money ... ”Such carriers that do not follow any civilized rules set the tone in the wild market, taking people out in the wrong field. And the "tentacles" of such Ufa entrepreneurs have already reached out to remote cities of the republic.

The fact is that state departments can check entrepreneurs only once every three years, or at the request of citizens, if the appeal indicates that the carrier has created a threat to the life and health of citizens.

“We are obliged to ensure that the lives of the inhabitants of Bashkiria are not endangered,” explains Sergey Nikolayevich. - The task of our department is to oversee the rule of law in the motor transport sector, and we, in my opinion, are fulfilling it. Carriers are well aware that we cannot stop their activities, if there are no serious reasons. And if we had complaints regarding certain violators, we could take specific measures - go to court in the interests of people or issue orders to eliminate violations.

In the near future, the head of the Bashkir Department of State Avtodornadzor is planning to place boxes at some terminal stops to collect complaints from the population about poor-quality motor transport services. UGADN for the Republic of Belarus also plans to distribute questionnaires in public transport, where the passenger could indicate the pros and cons of a particular carrier.

“Usually a person is dissatisfied in a minibus, notes how the driver exceeds the speed limit, slips through a red light, but, once at home, waves his hand at these problems - he got there and it’s good,” Sergey Nikolayevich explains the psychology of the passenger. “And now such a dissatisfied citizen will be able to complain to our department right at the bus stop.

Sergei Merezhko assures that it is not so easy to bring the violating carrier to justice - you need to prove that he really worked on the line, and did not go, for example, to a car wash, that he went on a flight without actually passing a medical examination, and for this you need to find a doctor who issued a fake certificate. And complaints from the population indicating the numbers of buses that violate the rules of transportation will help inspectors to restore order on the roads.

“This is a difficult area,” he explains. — Operational work is needed to gather together the evidence base. But we try to do it before going to court with a lawsuit.
- You have taken on unbearable work, - we say to Mr. Merezheko. “There are not many people in the administration. Are you ready for the flood of complaints that will fall on you?
“That's our job,” he shrugs.

To issue licenses for the right to transport, a “single window” was opened in the Bashkir UGDN. And, according to the inspectors, "according to the law, 45 days are allotted for paperwork, but if all the necessary requirements are met, the necessary papers can be obtained in a shorter time."

- Little to issue permits, - Sergey Nikolaevich is sure. — In order to be confident in the safe operation of hauliers, it is important to constantly monitor them. For example, they provide contracts for pre-trip examinations of drivers, but such a medical institution does not exist. Or they enter into a contract for the maintenance of buses with a garage, where they have not heard of such a document.

It is curious that Mr. Merezhko prefers to call private traders who left to earn extra money on personal GAZelles not "illegals", but "unscrupulous" carriers.
“Formally, they are not illegal immigrants,” Sergey Nikolayevich explains. - Most often they have vouchers issued by license holders right at the final stop. And in the license issued, by the way, by our department, it is said that the owner of such paper has the right to carry out passenger transportation on the territory of the Russian Federation. Unscrupulous bus owners take advantage of this blurring of the definition and put their cars on any route that seems especially profitable to them. And such actions are regulated by law - the carrier that won this route in the mayor's office should not tolerate infringement on its business and go to court. And we will help conscientious participants in the car market to achieve justice.

Sergei Merezhko assures that he is in favor of competition in the trucking market.
“But only those carriers who thoroughly follow the rules of the game should enter the routes,” he says. - And, therefore, they are responsible for the safety of passengers.

Sergey Nikolayevich believes that today he can help in the fight against unscrupulous carriers new article 263.1 of the Criminal Code, which entered into force in July 2010 "Failure to comply with the requirements for ensuring transport security." Now, according to the new criminal law, in the event of an accident with one victim or major damage (about a million rubles), an entrepreneur or a person who is entrusted with the duty to monitor the technical condition of the car can go to jail for three years. If a person dies in an accident, then the mechanic or businessman who owns the buses may be imprisoned for five years, and in the event of the death of two or more people, those responsible for the release of the bus on the line may end up on bunk beds for seven years. Moreover, the mechanic must have attestation documents confirming his right to provide such a service.

- The current novelty of the criminal law will make those who issue fake vouchers think. After all, if an unprepared driver, who only yesterday decided to earn money by driving and bought a waybill, makes an accident where people suffer, both the mechanic and the entrepreneur, whose signatures are on waybill. We believe that this innovation will greatly facilitate the supervision of unscrupulous carriers, and we will do our best to make this article work.
According to Sergei Merezhko, the other day one of these drivers in Ufa knocked down a woman on October Avenue near house number 80.

“This is exactly the case when not only the driver, but also the one who issued him a ticket, should be responsible for the accident,” Sergey Nikolayevich says harshly. — And, I hope, the new legislation will make many hotheads come to their senses, who believe that there is easy money in the trucking market.

But it is clear that no matter how enthusiastic the new head of the Bashkir UGADN possesses, neither he nor his subordinates alone can cope with the wild market of road transportation. In order for the fight against unscrupulous carriers to be successful, it is necessary that representatives of other authorities and departments sincerely worry about this field.

“We are limited by our powers,” Mr. Merezhko says. “Our inspectors are required to monitor the work and rest regime of drivers and their compliance with license requirements and safety rules. Stop the bus, which may violate the rules of transportation, can only traffic police officers. And, accordingly, only employees of the mayor's office have the right to ask on what basis this carrier ended up on a particular route - after all, the issuance of route cards is carried out in accordance with local legislation, and we have the right to control only the federal one.

- Maybe it is worth conducting raids, as in Kazan, where not only officials and state traffic inspectors, but also tax authorities and Rospotrebnadzor participated in the checks of carriers?
- To restore order, all means are good, - agrees Sergei Merezhko. — I believe that those who seek to work and earn money in this market will one day come to the conclusion that it is easier to comply with all requirements and work according to the rules than to break the law. I understand that this will take time, but the time of the spontaneous market is over, entrepreneurs will either have to obey the law or leave this business.

The Federal Service for Supervision in the Sphere of Transport is responsible for various issues. Which ones are on this moment are the most relevant?

Areas of activity requiring great attention, regardless of time, is the safety of transportation of citizens and the safety of transportation of dangerous goods. And our responsible task is to exercise control and supervision over strict compliance with the legislation of the Russian Federation. The department grants a license for the right to transport passengers by road transport equipped for transportation of more than eight people, checks for compliance with license requirements. We also control international transportation: and this is not only transportation by residents of the republic, but also transit transportation foreign citizens. Another aspect of the activities of the Department is the issuance of special permits for the movement of a vehicle carrying dangerous goods on the roads, certificates of admission to international road transport. Last year, we did colossal work in this direction: more than two thousand traffic routes were agreed upon. We also monitor compliance with the requirements for the safety of federal roads: M5, M7 and Ufa-Orenburg. We control the condition of the road surface, bridges and overpasses, stopping points, take measures against the appearance of unauthorized exits. And we can say that the roads in the republic are in good condition.

The sphere of passenger transportation always causes a lot of discussions?

Yes, indeed, we are often asked to put things in order in the area of ​​supposedly illegal transportation. But the fact is that we don't have such people in the republic: the carrier either has an appropriate license, or carries out activities for the transportation of passengers, which have a notification character. Of course, isolated cases are revealed - once or twice a year, but these are rather private bus drivers who decided to make money. As for entrepreneurs who do not participate in the competition of the municipality and operate in parallel with official carriers, I think that businesses need to resolve this issue on their own, by increasing the number of buses at their enterprise, or by entering into contractual relations with partners in this area.
