From 2019, almost all purchases under the contract system, as well as purchases by state companies for small and medium-sized businesses, will be carried out only in electronic form. Both categories of procurement will take place on electronic platforms from a closed list, and a single accreditation in the Unified Information System will begin to apply for suppliers.

The government has already approved a list of operators on whose platforms electronic government procurement and procurement of state-owned companies with the participation exclusively of SMEs can take place:

  1. "Agency for State Order of the Republic of Tatarstan."
  2. "Unified electronic trading platform."
  3. "Russian Auction House".
  4. "TEK - Torg".
  5. "Electronic trading systems."
  6. "Sberbank - Automated trading system."
  7. "RTS - tender."
  8. "Electronic trading platform GPB".

LLC “Automated System of Bidding for State Defense Orders” became a specialized platform for conducting closed procurements.

Procurement from sites on the closed list will begin after the Ministry of Finance and the Federal Antimonopoly Service sign agreements with operators. It is expected that this will happen before October 1, 2018, when the sites will be tested for compliance with the requirements of the Government of the Russian Federation. For example, these include the site’s ability to conduct at least 10,000 electronic procedures per day, the presence of two servers with 6 cores each, 4 GB RAM, 1000 GB storage, etc.

In turn, these operators will have to fulfill a number of obligations during their work:

  • Provide 24/7 support to contract system participants by phone and email. Questions via email must be answered by the end of the next business day. The average waiting time for a call to be answered should not exceed 5 minutes. However, the requirement states only about requests from participants in the contract system, and not from participants in procurement under Law No. 223-FZ.
  • The operator can charge a fee only for winning - it is 1% of the NMCC, but not more than 5,000 rubles. For the winner of the purchase, the participants of which could only be small enterprises, the maximum absolute amount was reduced to 2,000 rubles (Resolution of the Government of the Russian Federation dated May 10, 2018 No. 564).
  • When sending information and electronic documents received from a procurement participant to the customer, the operator is obliged to ensure their confidentiality before summing up the procurement results. At the same time, the operator ensures the safety and reliability of information posted on the electronic platform and signed with an electronic signature for at least 10 years (clause 22 of the Uniform Requirements). The need to comply with this requirement cancels the general rule of the Law “On Personal Data”, according to which personal data must be deleted by the operator at the request of the subject of this same data.

Blocking and unblocking participant funds

According to the new rules, a participant in an electronic procurement that takes place on a site from a closed list interacts directly with the bank. He himself must open a special account at the bank and provide a sufficient amount in it to block the security of the application he submitted. This can be done at the bank with which the site will enter into an agreement. The list of such banks was approved by Order of the Government of the Russian Federation dated July 13, 2018 No. 1451-r.

It is important that the procedure and cases of blocking and unblocking of funds in a special account by the bank will be regulated by the agreement between the bank and the platform operator (Resolution of the Government of the Russian Federation of May 30, 2018 No. 626).

The fact is that now this order may raise questions. For example, in Law No. 223-FZ, some norms are formulated in such a way that their literal implementation threatens to be violated (for example, from Part 15 of Article 3.4 of Law No. 223-FZ it literally follows that 1 + 1 = 1). And the additional requirements approved by Resolution No. 657 only partially regulate the issues of blocking and unblocking funds of SMEs when participating in procurement under Law No. 223-FZ.

Supplier accreditation

Until January 1, 2019, accreditation of procurement participants under the contract system, as well as procurement of state-owned companies for small and medium-sized businesses, is carried out in accordance with Art. 61 of Law No. 44-FZ on each electronic platform separately. To register on the site, the future procurement participant provides the operator with:

  1. application for accreditation;
  2. a copy of an extract from the Unified State Register of Legal Entities;
  3. copies of constituent documents;
  4. copies of documents confirming the authority of a person to obtain accreditation on behalf of this participant;
  5. Copies of documents confirming the authority of the head;
  6. email address for sending notifications and other information;
  7. decision on approval or execution of transactions based on the results of electronic procurement on behalf of this procurement participant.

However, from January 1, 2019, centralized accreditation using the EIS is introduced (Article 24.2): the supplier is accredited only in the EIS, and if the EIS accredits it, then the next day the supplier automatically receives accreditation at all selected sites. The procedure for accreditation in the Unified Information System and the list of required documents must be determined by the Government of the Russian Federation by the end of 2018.

By default, supplier accreditation lasts three years. However, a supplier that receives accreditation in December 2018 will not be able to participate in electronic procurement until the end of 2021 if it does not register in the Unified Information System (Part 47, Article 112 of Law No. 44-FZ) by the end of 2019.

Please note that the rules for registration for participation in regular procurement under Law No. 223-FZ and after 2019 are determined by the electronic platform itself, and such registration is carried out on each site separately.

Registration of suppliers in the Unified Information System

Starting next year, all suppliers under government orders must be registered in the Unified Information System. Without this, it will be impossible to apply for participation in the auction. The system will maintain Register of suppliers, which will include information about each participant. In this regard, the Government will have to determine the procedure for such registration and the list of necessary documents.

Now about registration of suppliers in the Unified Information System This is what is known:

Registration in ERUZ EIS

From January 1, 2019 to participate in tenders under 44-FZ, 223-FZ and 615-PP registration is required in the ERUZ register (Unified Register of Procurement Participants) on the EIS (Unified Information System) portal in the field of procurement zakupki.gov.ru.

We provide a service for registration in the ERUZ in the EIS:

  1. She will be free.
  2. Registration will only be possible in electronic format.
  3. Registration validity period - 3 years, that is, the same as now on electronic platforms.
  4. Not earlier than in 6 months before the end of the registration period, the participant can begin the re-registration procedure for the next 3 years.
  5. If there is still time left until the end of registration less than 3 months, the participant will not be able to submit applications for new auctions.
  6. The law prohibits registration in the EIS offshore companies.

Introduction of new electronic procedures

From July 1, 2018 customers have the opportunity to conduct electronically not only auctions, but also competitions, as well as requests for quotations and proposals. And since 2019, this has been their responsibility. Thus, all competitive procedures are transferred to electronic format and will be held at the ETP. On paper, only contracts with a single supplier will be concluded.

Changes in the accreditation procedure for the ETP

Currently, suppliers must be accredited on an electronic platform to participate in tenders. There are 6 sites that carry out procedures under 44-FZ. Which of them to carry out the purchase is decided by the customer at his own discretion. Accordingly, in order to have access to all tenders under 44-FZ, the supplier has to register on all ETPs. Each site has its own procedure and set of documents.

But after transferring all trading to the ETP, everything should change. Participants will not have to undergo accreditation at each site - it will be enough to pass registration in the EIS. The information system itself will interact with the ETP. Moreover, accreditation must be received on the next business day. The period of accreditation for the ETP will correspond to the period during which the company or individual entrepreneur has a valid registration in the EIS.

This accreditation procedure is certainly a big plus, since you don’t have to waste time interacting with each ETP separately. Moreover, they have slightly different requirements for participants. Another advantage is that no one can request from the supplier any other documents other than those that he provided during registration in the Unified Information System.

Transition period

Everything should be up and running in 2019, but the transition will begin very soon. Until January 1, 2019 the accreditation procedure for the ETP will remain the same (in accordance with Article 61 of Law 44-FZ). The ETP operator will enter data about the participant into its register, which is maintained at the sites in accordance with the requirements of Article 62 of the law.

During 2019 Bidders must be registered in the Information System. Repeated accreditation to the ETP will be possible strictly through the Unified Information System. Most likely, if in 2019 a participant has accreditation for the ETP, then his data will be transferred to the EIS automatically. That is, it is possible that the participant (with valid accreditation at the site under 44-FZ) will not have to register in the UIS on his own - the ETP will do this for him.

New sites

It has not yet been precisely determined which ETPs will conduct trading in electronic form under 44-FZ. Currently only . It is quite possible that their list will change, including new trading operators. The participant will not have to undergo accreditation at the new site- being registered in the EIS, he will receive it automatically.

In this article we want to consider the issue related to the registration of procurement participants (suppliers) in a unified information system (abbreviated as UIS). Until recently, only organizations placing orders (Customers) were registered on the official website zakupki.gov.ru. However, in December 2017, Federal Law No. 504-FZ “On Amendments to the Federal Law “On the Contract System in the Sphere of Procurement of Goods, Works, and Services to Meet State and Municipal Needs” was adopted. According to this law, from January 1, 2019, procurement participants will also have to undergo mandatory registration on the EIS website. But let's talk about everything in order.

Why will participants need to register on the unified information system website?

Until July 1, 2018, within the framework of 44-FZ, only one single procedure was carried out electronically - an auction in electronic form. Electronic auctions were held on 6 specially selected electronic trading platforms (abbreviated ETP). And in order to be able to take part in these auctions, the participant had to be accredited on electronic platforms. And since Customers are in no way limited in their choice of platforms for holding electronic auctions, suppliers had to undergo accreditation at all 6 sites in order not to miss the opportunity to take part in the procurement they needed.

From July 1, 2018, Customers received the right to conduct electronically not only auctions, but also tenders, requests for proposals, and requests for quotes. All these purchases are also carried out at previously approved ETPs, plus 3 new ETPs have been added to these sites.

But starting from January 1, 2019, Customers are required to make all purchases exclusively electronically. In this regard, a Unified Register of Procurement Participants has appeared on the EIS website, which will include information about each supplier. The maintenance of this register is assigned to the Federal Treasury. Until 2019, such registers of accredited procurement participants were maintained by ETP operators separately at each site.

From January 1, 2019, registration of procurement participants in the unified information system has become a mandatory condition for obtaining the opportunity to participate in all electronic procurements carried out within the framework of 44-FZ.

Thus, the supplier must first register in the Unified Information System, and then operators of electronic platforms, no later than the business day following the day the supplier is registered in the unified information system, accredit such a participant on the electronic platform. This accreditation is carried out through information interaction between the electronic platform and the Unified Information System.

By registering on the website zakupki.gov.ru, you will automatically be accredited on all electronic platforms. For suppliers, this is a definite plus, since there is no need to waste time on accreditation at each site. However, the accreditation period remained the same - 3 years. And no earlier than 6 months before the end of registration of a participant in the UIS, he has the right to register for a new term.

It is worth noting that when 4 months remain before the end of the supplier’s registration in the UIS, he will receive a corresponding notification from the site about the need to renew the registration for a new period. If a participant does not take care in advance about extending his registration period, then 3 months before the end of the registration period he will no longer have the opportunity to submit applications for participation in electronic procedures. Therefore, it is very important to re-register on the EIS website on time.

Procedure and deadlines for registering a procurement participant on the EIS website + list of required documents

According to Part 1 of Art. 24.2 44-FZ registration of procurement participants in the unified information system is carried out in electronic form on the basis of information and documents in the manner and within the time frame determined by Decree of the Government of the Russian Federation of December 30, 2018 No. 1752 “On the procedure for registering procurement participants in the unified information system in the field of procurement goods, works, services to meet state and municipal needs and maintain a unified register of procurement participants and amend the Decree of the Government of the Russian Federation of June 8, 2018 N 656.”

Nuances of registering suppliers in the EIS

Below we have provided a list of important nuances regarding the registration of procurement participants on the website zakupki.gov.ru:

  1. Registration is carried out electronically;
  2. There is no registration fee;
  3. Information about the participant and his documents are entered into the unified register of procurement participants (abbreviated as ERUZ);
  4. Registration is carried out for a period of 3 years, this procedure can be repeated no earlier than 6 months before the end of registration;
  5. If there are less than 3 months left until the end of registration on the EIS website, the participant cannot submit applications to participate in electronic procedures;
  6. During registration, it is not allowed to require from the participant information and documents that are not provided by the Government of the Russian Federation;
  7. The EIS does not allow registration of offshore companies;
  8. When accrediting to an ETP, the site operator does not have the right to demand additional information and documents from the participant;
  9. A procurement participant who has registered on the EIS website has the right to participate in all procurements conducted on electronic platforms within the framework of 44-FZ;
  10. Procurement participants accredited at the sites, but not registered in the Unified Information System, will be able to submit applications only until December 31, 2019.
  11. To register in the EIS, a qualified electronic signature is required.

Transition period

From July 1, 2018 to January 1, 2019, the procedure for accreditation of procurement participants on electronic platforms to participate in electronic procedures remains the same (Part 49 of Article 112 of 44-FZ).

From January 1, 2019, accreditation of procurement participants on electronic platforms is carried out after registration of such participants in the Unified Information System in accordance with Art. 24.2 44-FZ (Part 48, Article 112 44-FZ).

From January 1, 2019 to December 31, 2019 inclusive, procurement participants previously accredited on electronic platforms to participate in electronic procedures are required to register in the Unified Information System (Part 47 of Article 112 of 44-FZ).

Until December 31, 2019 inclusive, filing applications for participation in electronic procedures and participation in such procedures are carried out, including by persons who were accredited before January 1, 2019 on the electronic platform, whose information and documents are included in the register of participants in the electronic auction who have received accreditation on the electronic site. At the same time, they will not need to register in the Unified Information System (Part 50, Article 112 of 44-FZ).

The old procedure for accreditation of participants on electronic platforms ceased to apply on January 1, 2019.

Persons acting as potential suppliers within the framework of the Law “On the contract system in the field of procurement...” dated 04/05/2013 No. 44-FZ (hereinafter referred to as Law No. 44-FZ) from 01/01/2019 must register in the Unified Information System. Persons accredited on the trading platform must register before the end of 2019 (clause 47, article 112 of law No. 44-FZ). During 2019, operators of electronic platforms must make it impossible for persons who have not registered in the Unified Information System to submit applications 3 months before the end of the accreditation period for this person on the site (Resolution of the Government of the Russian Federation of December 30, 2018 N 1752).

At the same time, regions may have their own supplier portals (for example, the “Supplier Portal” subsystem of EAIST in Moscow), however, this practice is not widespread, so it is not discussed in this article.

There are several main stages of the registration procedure:

  • Receipt and installation by the organization of an electronic digital signature key (hereinafter referred to as EDS). We also recommend reading the article “Procedure for obtaining digital signatures for government procurement (nuances).”
  • Registration of an organization and its representative, who will act as an administrator in the unified information system of the Site (hereinafter referred to as the UIS).
  • Registration of other UIS users from this organization who have an electronic signature.
  • Setting up access for UIS users who do not have the functions of an organization administrator.

Obtaining an electronic signature

Before starting the registration procedure on the government procurement website (no matter under which law - No. 44-FZ or 223-FZ), you must obtain an electronic signature tool with a qualification certificate of the verification key (see clause 2 of Article 5 of Law No. 44-FZ , clause 18, article 4 of law No. 223-FZ, clause 1.5 of order No. 27n).

You can obtain an electronic digital signature at the certification center of the Ministry of Telecom and Mass Communications of the Russian Federation or at certification centers accredited by the named executive body of the Russian Federation (clauses 5.2.25.17-5.2.25.18 of the Decree of the Government of the Russian Federation “On the Ministry of Telecom and Mass Communications of the Russian Federation” dated 02.06.2008 No. 418). The list of such accredited certification centers is published on the official website of the Ministry of Telecom and Mass Communications of the Russian Federation on the Internet.

The persons who need to obtain an electronic signature are (see clause 4.1-4.3 of Order No. 27n):

  • the head of the organization (i.e., a person who has the right to act without a power of attorney on behalf of a given legal entity, according to information from the Unified State Register of Legal Entities);
  • every employee of the organization who needs access to the UIS.

The form and list of information included in the EDS verification key certificate are regulated by clause 2 of Art. 14, paragraph 2, art. 17 of the Law “On Electronic Signatures” dated April 6, 2011 No. 63-FZ (hereinafter referred to as Law No. 63-FZ). In particular, these include the last name, first name, patronymic, SNILS and INN of the authorized person - the owner of the qualification certificate.

The technical side of the issue of installing a certificate is described in detail in the instructions, in the section “Instructions for setting up a workstation”.

Registration on the government procurement website under Federal Law No. 44-FZ

In accordance with Order No. 27n (clause 1.3-1.4), organizations included in the consolidated register (i.e., the register of participants in the budget process), approved. by order of the Ministry of Finance of Russia dated December 23, 2014 No. 163, are registered in the Unified Information System by the Federal Treasury.

Registration of organizations that are not subject to inclusion in the consolidated register is carried out after the named legal entities have completed the identification and authentication procedure on the government services website.

A detailed description of the procedure for registering organizations and their representatives in the UIS is contained in the following sources:

  • in sections III-V of order No. 27n;
  • in paragraph 2 of the instructions;
  • in paragraph 2 of the manual.

In this case, registration in the UIS of an organization subject to inclusion in the consolidated register is carried out automatically after the UIS receives information from the consolidated register. At this stage, a customer identification code is generated and a letter about the organization’s registration in the Unified Information System is sent to the email address specified by the organization when submitting an application for inclusion in the consolidated register.

Next, the head of the enterprise must log into his personal account on the official government procurement website and fill out the registration form for the organization’s administrator. Login to the UIS is carried out using the EDS verification key certificate. If the specified form is filled out correctly, the administrator’s registration will take place automatically (clause 4.3 of order No. 27n).

Legal entities whose information is not subject to inclusion in the consolidated register are registered by the head on the government services website in the “Registration of Legal Entities” section, after which the organization’s administrator logs into his personal account in the Unified Information System for authorization (select the “Personal Account 44-FZ” icon).

Registration on the government procurement website under Federal Law No. 223-FZ

To work with the Unified Information System in accordance with the provisions of Law No. 223-FZ, legal entities whose information should not be included in the consolidated register must go through the registration procedure in the “Registration of Legal Entities” section (clauses 1.1, 1.4 of Order No. 506, clause 1.4 order No. 27n).

The specified data is checked for correctness by the system of the public services portal, and if the results of the check are positive, the legal entity is included in the register of legal entities, and the head of such a legal entity is included in the register of individuals.

After this, an authorized person who has administrator or additional administrator rights must go through the authorization procedure in his personal account in the EIS system (select the “Personal Account 223-FZ” icon).

Login is made through the use of a qualified electronic signature verification key certificate (clause 1.5 of order No. 506).

After successfully completing the authorization procedure, the organization’s registration form appears in the Unified Information System, which is filled out automatically based on data from the information system of the public services portal. You need to check that it is filled out correctly and click the “Register” icon.

In relation to organizations whose information is subject to inclusion in the consolidated register, the procedure described in Section III of Order No. 27n is applied.

In case of successful registration and authorization, a notification about this will be sent to the email specified when sending the application for registration of the organization. To confirm registration, the organization administrator must follow the link contained in this letter.

After this, the rest of the organization’s employees who will subsequently need access to the UIS can be registered.

Thus, the registration process on the government procurement portal within the framework of laws No. 44-FZ and 223-FZ is generally similar and involves separate stages of registration:

  • the organization itself;
  • administrator / additional administrator of the organization;
  • other employees of the organization.

Before the registration procedure in the UIS, it is necessary to issue and obtain an electronic digital signature from the authorized federal executive body (Ministry of Telecom and Mass Communications of the Russian Federation) or from certification centers accredited by it.

Having analyzed search queries related to the subject of procurement, we noticed that the process of registering customers in the UIS raises quite a lot of questions. In essence, most of the information about the registration process is located directly on the Official EIS website in the “Training Materials” section, however, many are most likely confused by the fact that this is not some kind of social network where you can register in a couple of minutes by entering a minimum amount of data , but a tool for professional work in the field of procurement.

We will use the established one and try to disclose the procedure for registering in the UIS in a more accessible form.

Obtaining an electronic digital signature (EDS).

To carry out all legally significant actions in the Unified Information System on the website zakupki.gov.ru, you will certainly need an electronic digital signature (EDS). In particular, according to paragraph 3 of part 1 of article 4 of Law No. 44-FZ, to sign documents in the Unified Information System we will need enhanced unqualified electronic signature (hereinafter referred to as EDS).

In our case (customer under 44-FZ), it is allowed to use only certificates issued by the certification center of the Federal Treasury. Therefore, to obtain an electronic digital signature, we need to contact the nearest FC certification center.

The certificate issued by the Federal Treasury contains:

  • last name, first name, patronymic of the user for whom the signature is issued;
  • user's SNILS;
  • unique account number (SPZ code) of the organization;
  • authority of the organization;
  • user permission.

After receiving the electronic digital signature certificate, you can begin the registration procedure, which we will conditionally divide into two stages - setting up the software and directly registering in the UIS.

Software setup.

Perhaps most people find this stage to be the most difficult, since it involves the use of specific software that no one encounters in everyday life.

However, not everything is as scary as it seems - the EIS contains both the minimum system requirements for PC hardware and the requirements for installed software.

Hardware requirements:

  • processor with a clock frequency of at least 1.3 GHz;
  • RAM - at least 1 GB;
  • Internet channel bandwidth - at least 256 kbit/sec

Requirements for installed software to work with the Official EIS website:

  • Installed Internet browser Internet Explorer (version 10.0 and higher), or any other browser that supports Transport Layer Secyrity (TLS v.1.1 and higher RFC 5246), using Russian cryptographic standards;
  • CryptoPro CSP software.

Note that, in essence, the most correct work in the EIS is possible only through the Internet Explorer browser; work through other browsers does not guarantee obtaining the desired results.

Setting up a browser and installing specialized CryptoPro CSP software is unlikely to raise questions that are not answered in the instructions, but there is one caveat: if you are using Windows 8.1 and Internet Explorer has been updated to version 11, you must use this browser in compatibility mode in Internet Explorer 10. The fact is that in Windows 8.1, the browser is part of the operating system and its separate installation or removal and subsequent re-installation of a younger version of the browser is not possible; you have to use a “crutch” in the form of compatibility mode. Detailed instructions for installing this mode are described in the instructions indicated above.

After we have received the digital signature and configured the workstation (PC) to meet the requirements specified in the instructions, we can begin the registration process in the UIS.

To register an organization in the Unified Information System, it is necessary to have information about the organization in the Consolidated Register indicating the organization’s powers in the field of procurement. After receiving information about the organization from the Consolidated Register, the System generates a customer identification code (CIC), the organization is automatically registered in the UIS, information about the organization is stored in the register of organizations in the UIS. A notification about the organization's registration in the Unified Information System is sent to the email address specified in the entry of information about the organization in the Consolidated Register. A corresponding entry is created in the event log of the organization’s card. To ensure the work of the organization's users in the Personal Accounts of the UIS, the administrator of the organization must log in to the UIS in order to confirm the registration of other users of the organization.

When clicked, a login form is displayed with a choice of options. You must select the option " Login for users of organizations registered in accordance with section III The procedure approved by Order of the Federal Treasury dated December 30, 2015 No. 27n, and the Procedure for registration in the Unified Information System approved by Order of the Federal Treasury dated March 25, 2014 No. 4n ».

After filling out all the required fields, you need to click the “ Register" After this, the system will register the user in the UIS and display the Personal Account of the Organization Administrator. This completes the registration process.
