Definition 1

The deposit of the arbitration court is an account for accounting Money received at the temporary disposal of arbitration courts to provide security for reimbursement of possible costs for the defendant, the so-called counter security.

On the deposit accounts of arbitration courts, funds are placed as counter security when the arbitration courts accept an application for an interim measure and a petition to suspend the execution of judicial acts, as well as money that is necessary when paying court costs, including payments to experts, witnesses.

The purpose of the payment should reflect the reason why the payment is being made, indicating the arbitration case number.

For legal entities sums of money are paid on the basis of payment orders of the applicant.

Citizens and individual entrepreneurs who do not have bank accounts, pay by payment documents allowing banks to carry out these operations.

Remark 1

Paid settlement documents with marks of credit institutions are confirmation of the deposit of money on the deposits of the arbitration court. Copies of payment documents, according to which funds were deposited to the deposit accounts of the arbitration court, must be submitted to the judges for joining the arbitration case.

Transfer of funds from the deposit of the arbitration court

The internal regulations of the arbitration court fix the procedure for the return of funds placed on deposit accounts.

If the arbitration court has accepted the ruling on the return of money from the deposit, its depositor with this ruling shall apply to the accounting department of the arbitration courts with an application for the return, indicating the numbers of the accounts to which these amounts should be transferred.

Remark 2

It is better to prepare two copies of the application. After endorsement of this document, the first copy will remain with the contributor as a confirming fact and the deadline for submitting the document.

This application is usually accompanied by original payment documents on payments made, if it is necessary to return the entire amount.

If it is necessary to return only part of the funds, it is enough to provide a photocopy of the original documents of the payments made. In addition to confirmation of payment, the application is accompanied by a court decision on cases or certificates from the fact that there are circumstances that allow the return of part of the paid deposit.

From deposit accounts, funds may be transferred only by the accounting department of the arbitration court in accordance with a judicial act, which contains in the final part an instruction on the payment of money to a person participating in the case at the expense of funds contributed in the manner of counter security, or on the return of funds to the payer.

The return of erroneously credited funds, including the erroneous crediting of the state fee, is carried out on the basis of written statement payer with bank details.

At the same time, the transfer of funds is possible only in a non-cash manner on the basis of settlement documents: for legal entities to their current accounts, and for citizens to personal accounts opened with banks.

In the absence of bank details, payment according to judicial acts is not made.

Remark 3

If the parties do not claim the deposit funds, including erroneous transfers of the state fee, they are debited from this account after the limitation period (three years), with the subsequent transfer of the unclaimed amount to federal budget revenues.
